1. Acceptance of Terms

By accessing or using RecruitHub ("Platform", "we", "us") at hirethebest.online, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

These Terms apply to all users — Employers, Consultants, Candidates, Partners, and Admins.

2. Platform Description

RecruitHub is a recruitment marketplace that connects:

• Employers who post job openings and deposit fees into escrow
• Consultants (recruitment professionals) who place candidates and earn commissions
• Candidates who receive invitations and apply for positions

RecruitHub uses an escrow system where employer deposits are held securely and released to consultants only upon successful placement (candidate accepts offer letter).

3. User Accounts & Eligibility

• You must be at least 18 years of age to create an account
• You must provide accurate, complete, and current registration information
• You are responsible for maintaining the confidentiality of your login credentials
• One person may not maintain multiple accounts for the same role
• Accounts are non-transferable
• You must notify us immediately of any unauthorized account access

4. Employer Terms

• All job postings must be for genuine, real positions within your organization
• Job descriptions must be accurate and not misleading
• The escrow deposit is mandatory before a job goes live
• Deposits are refundable within 60 days if no placement occurs
• You may accept or reject consultant service offers at your discretion
• You must not contact candidates directly bypassing the platform consultant
• Discrimination based on religion, caste, or political affiliation is strictly prohibited
• False job postings will result in immediate account suspension and deposit forfeiture

5. Consultant Terms

• Consultants must complete KYC verification before withdrawing earnings
• You must only invite candidates who have given consent to be represented
• You may not misrepresent job details to candidates
• Earnings are credited to your wallet upon candidate's offer acceptance
• Withdrawals are processed to verified bank accounts within 2–3 business days
• You may not place the same candidate for multiple employers simultaneously without disclosure
• Creating fake candidate profiles or submitting false applications will result in permanent ban and wallet freeze

6. Candidate Terms

• All information provided in your profile and application must be truthful
• Falsifying qualifications, experience, or documents is grounds for permanent ban
• Once you accept an offer letter, you are expected to join on the stated date
• No-shows without notice after offer acceptance may affect your platform standing
• You may decline invitations or offers at any time without penalty
• Your contact information will only be shared with the consultant who invited you

7. Escrow & Payment Terms

Our escrow system works as follows:

• Employer deposits the minimum posting fee before job goes live
• Funds are held in escrow — neither employer nor consultant can access them
• Upon candidate accepting the offer letter, funds are auto-released to consultant's wallet
• If no placement occurs within 60 days, employer receives a full refund
• Payment processing fees (Razorpay: ~2%) are borne by the employer
• GST (18%) is applicable on platform service fees as per Indian tax law
• Disputed payments will be reviewed within 7 business days

8. Prohibited Conduct

You may not use RecruitHub to:

• Post fraudulent jobs or create fake accounts
• Scrape, harvest, or collect user data without consent
• Send spam or unsolicited messages to other users
• Attempt to hack, reverse-engineer, or disrupt the platform
• Violate any applicable Indian or international law
• Impersonate any person or organization
• Upload malware, viruses, or harmful code
• Share platform access credentials with third parties
• Conduct off-platform hiring to avoid escrow fees

9. Intellectual Property

All platform content — including design, code, logos, and text — is owned by RecruitHub. You may not copy, reproduce, or distribute platform content without written permission.

User-generated content (job descriptions, candidate profiles) remains owned by you. By posting it, you grant RecruitHub a non-exclusive license to display it on the platform.

10. Limitation of Liability

RecruitHub is a marketplace platform. We are not an employer, employment agency, or guarantor of job offers or candidate quality.

• We are not liable for candidate no-shows, false information, or employment disputes
• We are not responsible for employer business decisions or hiring outcomes
• Our maximum liability is limited to fees you paid to RecruitHub in the past 3 months
• We are not liable for indirect, incidental, or consequential damages

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice. Upon termination:

• Active job postings will be closed
• Pending escrow amounts will be refunded to employers
• Verified consultant wallet balances will be paid out within 30 days
• Your data will be retained as required by law (typically 7 years for financial records)

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in [Your City], India. We encourage resolution through our grievance process before litigation.

For disputes under ₹20 lakhs, we prefer arbitration under the Arbitration and Conciliation Act, 1996.
